1. Who you are contracting with
These Terms & Conditions ("Terms") govern your access to and use of Coverage IQ (the "Service"), operated by Josh Dowis ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
2. The Service
Coverage IQ is an informational tool that analyzes commercial auto insurance policy documents using artificial intelligence to surface potential coverage gaps and provide premium benchmarking. The Service is informational only and is not a substitute for licensed insurance, legal, or financial advice. You are responsible for verifying any output and consulting a qualified professional before making coverage decisions.
3. Eligibility & accounts
You must be at least 18 years old and have authority to bind any organization on whose behalf you use the Service. You are responsible for the confidentiality of your account credentials and for all activity that occurs under your account.
4. Acceptable use
You agree not to:
- Use the Service unlawfully, fraudulently, or to harass others;
- Upload content you do not have the right to share;
- Attempt to interfere with the Service's security or probe, scrape, or reverse engineer it;
- Use the Service to generate, distribute, or host malware, spam, or infringing content;
- Attempt to manipulate the AI to generate prohibited, deceptive, or harmful output.
5. AI output
AI-generated analyses may be incomplete or inaccurate. You are responsible for your prompts, the files you upload, and how you act on the outputs. You must have the right to upload any policy document you submit. We may remove or restrict content and refuse or filter outputs at our discretion.
6. Intellectual property
We retain all rights, title, and interest in the Service, including software, designs, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have purchased. You retain ownership of policy documents you upload and grant us a limited license to host and process them solely to provide the Service.
7. Payment, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.
8. Service availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, or events beyond our reasonable control may interrupt access.
9. Suspension & termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends immediately.
10. Disclaimers & liability
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties including merchantability and fitness for a particular purpose. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to fees you paid in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill.
11. Changes
We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which the operator is established, without regard to conflict-of-laws principles.
